The York County Board of Commissioners met according to law on Tuesday, October 24, 2017 at 8:30 a.m. as per notice in the York News Times on October 19, 2017, with Chairman Jack Sikes presiding, with Kurt Bulgrin, Randy Obermier, Paul Buller and Bill Bamesberger.  Also present at the meeting was Melanie Wilkinson, correspondent for the York News Times, Luke Fochtman, correspondent for KAWL radio, Christopher Johnson, County Attorney and Kelly Turner, York County Clerk.

 

The agenda of the meeting was posted on the bulletin board in the County Clerk’s office and a copy of the agenda was made available to each Commissioner.

 

Sikes announced that the Open Meetings Act was posted outside the door along with copies in the back of the Board Room.  Proof of publication was also available.

Willard Peterson, met with the Board to have a scheduled time on the Agenda to read a book from the Little Library to the Commissioners

A Public Hearing was held at 9:30 a.m. as published in the York News Times on October 10, 2017 to hear support, criticism, suggestions or observations relating to conditional use Zoning Permit application to allow more than one dwelling in the same quarter quarter section, applied for by, Russell and Mary Plock, located in the SE ¼ SW ¼ of 4-9-2W.

 

 Proof of publication was available.   Present at the hearing were Commissioners Bamesberger, Buller, Bulgrin, Obermier, and Sikes; Melanie Wilkinson for the News Times, Luke Fochtman, for KAWL radio, Clerk Kelly Turner, Benjamin Dennis, Zoning Administrator, Christopher Johnson, York County Attorney and Russell Plock.

 

Benjamin Dennis and Russell Plock spoke on the application to allow more than one dwelling in the same quarter quarter section.

A Public Hearing was held at 9:51 a.m. as published in the York News Times on October 10, 2017 to hear support, criticism, suggestions or observations relating to a conditional use zoning permit application to allow a commercial fertilizer storage building in the general agricultural zoning district, applied by Peter Grobler, located in the NE ¼ of the NE ¼ of 14-11-2W

 

Proof of publication was available.   Present at the hearing were Commissioners Bamesberger, Buller, Bulgrin, Obermier, and Sikes; Melanie Wilkinson for the News Times, Luke Fochtman, for KAWL radio, Clerk Kelly Turner, Benjamin Dennis, Zoning Administrator, Christopher Johnson, York County Attorney and Peter Grobler.

 

Benjamin Dennis and Peter Grobler spoke on the permit to build a commercial fertilizer storage building.

RESOLUTION #17-41

 

WHEREAS, the County Board of York County, the BNSF Railway Company and the State of Nebraska intend to make improvements to a railway grade crossing, located on Road J, in York County at DOT No 083425S.

 

WHEREAS, the parties have provided for the terms and conditions for making those improvements in a Supplemental Agreement.

 

WHEREAS, the County of York wishes to enter into this three- party agreement.

 

NOW, THEREFORE, BE IT RESOLVED, the County Board of York County hereby authorizes the County Board Chair to sign an agreement with the State of Nebraska, Department of Transportation and the BNSF Railway Company for the installation of flashing light signals and gates and cantilevers with constant warning circuitry on Road J at BNSF Railway Company DOT No. 083425S.

RESOLUTION #17-42

 

FOR AMENDMENT AND ADDENDUM TO NIRMA/NIRMA II INTERGOVERNMENTAL/INTERLOCAL AGREEMENTS

 

WHEREAS, York County has previously entered into Intergovernmental/Interlocal Agreement with various other Nebraska Counties and other public agencies to form and participate in the Nebraska Intergovernmental Risk Management Association (NIRMA) and the Nebraska Intergovernmental Risk Management Association II (NIRMA II) as authorized by the Intergovernmental Risk Management Act (Neb.Rev.Stat. 44-4301 et seq.) and the Nebraska Interlocal Cooperation Act (Neb rev. stat 13-801 et seq); and

WHEREAS, Counties and other Public Agencies as defined in Neb Rev.Stat 44-4303 are allowed to participate in said cooperative undertakings; and

WHEREAS, the Legislature has found that proper risk management requires the spreading of risk so as to minimize fluctuation in insurance needs and that benefits can be derived through the pooling of insurance purchasing by local government, and

WHEREAS, NIRMA and NIRMA II have provided coverages to the County in a cost effective way which meet and exceed that provided by standard insurance carriers; and

WHEREAS, NIRMA and NIRMA II provide risk management services such as loss prevention safety audits, claims and litigation management, and coverages tailored to address loss exposures counties and other related public entities face not economically available from other sources; and

WHEREAS, these coverages and risk management services are essential for the continued effective and efficient use of county taxpayer dollars; and

WHEREAS, the current Intergovernmental/Interlocal Agreements will expire on June 30, 2018 and

NOW, THEREFORE, BE IT RESOLVED, that the York County Board hereby:

1.     Extends its commitment to participate in NIRMA and NIRMA II for the period July 1, 2018 through June 30, 2021; and

2.     Declares that this Resolution shall serve as an amendment and addendum to the previous Intergovernmental/Interlocal Agreements entered into by the County Board, said Intergovernmental/Interlocal Agreement readopted by and incorporated herein by this reference as amended
